On social media, an Afghan man continued to harass and threaten a 14-year-old Swedish girl after he attacked and sexually assaulted her. He also demanded that she cover her body according to his Muslim customs.

However, the District Court decided against charging the Afghan for rape against a child and instead sentenced him to only one week’s community service.
The man claims to be 19 years old and, according to the judgment, has been found guilty of sexual abuse of a child, sexual exploitation of a child and unlawful persecution. All crimes were committed against the same girl.
The girl, who lives in Gothenburg, first contacted the Afghan on a social forum online before physically meeting each other. The Afghan, resident of Norrköping, was then 17 years old and aware that the girl was only 14.
It did not take long until the Afghan began staying overnight with the girl in Gothenburg. One night towards the end of 2016, after she had fallen asleep, he grabbed her between the legs inside her panties and, according to the girl, pushed her fingers into her abdomen. The girl repeatedly begged him to stop.
During the trial, the prosecution argued the Afghan committed the crime of rape against a child. However, the Gothenburg District Court considered that the “touch” was not “so advanced that it is comparable to sexual intercourse with regard to the nature of the violation and the circumstances”.
The man himself claimed that he had placed his fingers inside the 14-year genitals inside her trousers. However the court claimed the touch was “not so sophisticated” to constitute actual rape and instead classified the incident as a sexual abuse of a child.
According to the District Court, there had been “mischiefs” in the relationship between the man and the girl, which “seems to have been explained by the unequal growth conditions of the parties”.
By the end of December 2016, the Afghan demanded that the girl’s “clothing style” be changed. Text conversations between the two indicate that he called the girl a “whore” and threatened to kill her when she did not want to “hide her body with clothes” and follow his Muslim customs.
The Afghans also threatened the girl into having sex – otherwise he would finish her. He then forced sexual intercourse with her in a handicap toilet at the station in Norrköping. The girl reported that this happened despite her repeatedly shouting “no”.
The district court classified this event as the sexual exploitation of a child. According to the judgment, there was no rape because the Afghan man had only been “delayed” and showed “lack of attention to [the girl’s] will.
At the same time, the district court found that the intercourse was “not based on complete freedom and reciprocity” and that “much suggests that [the girl] did not want intercourse.”
After the girl decided to end the relationship, she blocked the man on social media, causing him to get angry and to create a variety of users at Instagram, He then sent numerous sexually aggressive messages to her and continually harassed her, classified as unlawful persecution.
General documents show that the man is a citizen in both Sweden and Afghanistan. He arrived to Sweden when he was ten years old with his mother and can not therefore be expelled under Sweden’s current legislation.
